Notification

 

G.S.R. 917 (E) :--    In exercise of the powers conferred by sub – sections (4B) and (6) of section  10E of the Companies Act, 1956  (1 of 1956), the Company Law Board hereby makes the following Regulations further to amend the Company Law Board Regulations,1991, namely : -

 

 

1.  ( 1 )     These regulations may be called as the Company Law Board (Amendment) Regulations, 2000.

 

     ( 2 )     They shall come into force on the date of their publication in the Official Gazette.

2.         In the Company Law Board Regulations, 1991,--

(a)    in regulation 2, in clause (e), after the words  “Principal Bench”, the following shall be added, namely :-

 

                          “,Additional Principal Bench”;

(b)   in regulation 4, -

(i)      after sub-regulation (1),  the following shall be inserted, namely:-

 

“(1A) It shall also be lawful for the Chairman to provide that matters falling under sections 235 and 237 of the Act and matters falling under Chapter VI of Part VI of the Act in so far as they relate to Southern Region shall be dealt with by a Bench consisting of not less than two Members (which shall be known as Additional Principal Bench).” ;

 

(ii)    after sub-regulation (2), the following shall be inserted, namely:-

“(2A) The Additional Principal Bench shall be at Chennai but it may sit at such places in the Southern Region as may be more convenient in exercise of its powers and functions.”;

 

(iii)  in sub-regulation (4):--

(a)     after the words, brackets and figures “sub-regulations (1)”, the brackets, figure and letter  “,(1A)”, shall be inserted;

(b)   in the proviso, after the words  “Regional Bench”,  the following shall be

inserted, namely :--

 

                    “ or the Additional Principal Bench”;

 

 (c )  in regulation 7, -

(i)   in sub-regulation (2),  after the words “Southern Region” ,  the following shall  be inserted, namely:--

 

“including Additional Principal Bench”;

 

(ii)  in sub-regulation (3), after the brackets and words “(Southern Region)”,  the following shall be inserted, namely:-

                                 

“including  Additional Principal Bench’’;

 

(d)    in regulation 34, in sub-regulation (3), after the word “Southern”, the following  shall be inserted, namely:-

 

“/Additional Principal Bench”;

 

(e)    in Annexure-I, against Sl. No. 3, after the words “Southern Region”,  under the heading “Region”, the following shall be inserted, namely :-

                                          

 “ / Additional Principal Bench’’;

 

(f)     in Annexure-II, -

(i)      in Form No. I, after the words “Principal Bench” , in the first line, the following shall be inserted, namely :-

                       

                  “/ Additional Principal Bench’’;

 

(ii)  in Form No. 3, in the first line, after the words “Principal Bench” , the      following shall be inserted, namely :

                       

                   “/ Additional Principal Bench’’.
